Welcome to ImgGo. This Service is provided by Bilal Sedef, an individual sole proprietor operating under the trade name "ImgGo", based in Istanbul, Turkey.

These Terms of Service ("Terms") govern your access to and use of the ImgGo platform, including our website, API services, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

ImgGo is a Software-as-a-Service platform that transforms user-uploaded images into structured data (manifests) based on user-defined patterns and schemas. The Service includes:

• Pattern creation and management (custom schemas with instructions)
• Image upload and processing via Web UI and API
• Structured output generation (JSON, YAML, XML, CSV, plain text)
• Webhook notifications for asynchronous job completion
• API key management for programmatic access
• Usage analytics and billing management

2. Account Registration and Eligibility

To use the Service, you must create an account. You represent and warrant that:

• You are at least 18 years old (or the age of majority in your jurisdiction)
• You have the legal capacity to enter into binding contracts
• All registration information you provide is accurate and current
• You will maintain the security of your account credentials
• You are responsible for all activities that occur under your account

3. Acceptable Use Policy

You agree not to use the Service to:

• Upload, process, or distribute illegal, harmful, or abusive content
• Process images containing child sexual abuse material (CSAM) or illegal pornography
• Violate intellectual property rights of others
• Transmit malware, viruses, or malicious code
• Attempt to bypass rate limits, authentication, or security measures
• Interfere with or disrupt the Service or servers
• Scrape, harvest, or collect user data without authorization
• Resell or redistribute the Service without express written permission

4. API Usage and Rate Limits

API access is subject to plan-specific limits:

• Request Limits: Each plan includes a monthly request quota. Exceeding your quota may result in throttling or overage charges.
• Rate Limits: Burst rate limits apply per second to prevent abuse. Violations may result in temporary API blocks.
• Fair Use: Plans include reasonable image size and token limits. Excessive usage beyond fair use thresholds may require plan upgrades.
• API Keys: You are responsible for securing your API keys. Do not expose keys in client-side code or public repositories.

Paid plans are billed through Paddle. By subscribing to a paid plan, you agree to:

• Subscription Terms: Monthly or yearly billing cycles. Subscriptions auto-renew unless canceled.
• Payment Method: You authorize us to charge your payment method for all applicable fees.
• Price Changes: We may change pricing with 30 days' advance notice. Changes apply on your next billing cycle.
• Taxes: Prices exclude applicable taxes. You are responsible for all taxes.
• Late Payment: Overdue accounts may result in service suspension or termination.

7. Service Availability and Modifications

We strive to maintain high uptime, but we do not guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service with or without notice
• Perform scheduled maintenance that may temporarily affect availability
• Update features, limits, or functionality of any plan tier
• Impose new or additional limitations on the Service

8. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Accuracy, completeness, or reliability of AI-generated outputs
• Uninterrupted or error-free operation
• Fitness for a particular purpose
• Non-infringement of third-party rights

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMGGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to ImgGo in the 12 months preceding the claim, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless ImgGo from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third-party rights.

11. Termination and Account Deletion

Either party may terminate your account:

• By You: You may cancel your subscription at any time from your account settings. Paid subscriptions remain active until the end of the billing period.
• By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for non-payment.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
